Puerto Escondido Real Estate

According to the Mexican Constitution of 1917, only Mexican citizens and corporations can own property in the "Restricted Zone".
The restricted zone includes all of Mexico coastline, 50 kilometers or 32 miles from the oceans: Pacific Ocean, Gulf of Mexico, Baja California and the Yucatan Peninsula, also 100 kilometers or 64 miles from the border states to the north States and the south by Guatemala and Belize.
The modern government of Mexico realized that this law was not friendly to foreign investors, so that in 1971 the Mexican Foreign Investment Act established a mechanism called "Trust".
The Fideicomiso (Bank Trust), which allows foreigners to own property in the Restricted Zone indirectly, actually began in 1973, and settled for a period of 50 years, renewable once.
A second option was for foreigners to own through a Mexican corporation.
These two forms of ownership are different and you should consult an AMPI professional or real estate lawyer, they can give you advice on what best applies to your needs. In most cases, people choose to do so through a trust.
Definition of Trust
A trust is a contract of 3 parts, in which the property owner irrevocably transfer property to a bank (trustee), for a buyer (third party) registered in a trust as the beneficiary, the same, can use, enjoy, remodel, repair, sell such property (real estate). There may be more than one beneficiary in a trust.
The transfer of real property of an owner / seller to a bank is final and irrevocable transfer of writing.
Like many European countries, Mexico is working under the Napoleonic code and all property transactions must be made through a notary public (lawyer real estate). The Notary is the highest legal figure in the country.
The closures will take about 30 working days. The office of Attorney and real estate agent is responsible for preparing the documentation necessary for a successful closing. Then the deed / title is recorded in the Public Registry of Property.
